Course overview

Compliance in one country is a technical problem. Compliance across twenty is a coordination problem, and the difficulty is not that the rules are complex; it is that they conflict. A data protection rule in one jurisdiction can forbid the transfer that a supervisor in another jurisdiction requires. A sanctions regime can prohibit a transaction that is lawful and even encouraged where it originates.

This course covers global financial compliance across five units: the foundations, global regulatory frameworks, financial crime controls, cross-border compliance risk, and building resilience. It is educational and is not legal advice; obligations must be confirmed with qualified counsel in each jurisdiction.

Conflicting obligations, and what to do about them

There is no clever answer that makes a genuine conflict disappear. What competent compliance functions do is identify the conflict early, document it, seek regulatory guidance where possible, and make a reasoned decision with legal advice, recorded contemporaneously. What weak functions do is choose the path of least resistance and hope nobody notices, which works until an inspection or an enforcement action reveals the choice.

The other structural challenge is consistency. A global standard applied everywhere is expensive and often exceeds local requirements. A local standard everywhere is cheaper and creates gaps. Most organizations settle on a global minimum with local uplift, and the discipline is in maintaining it as rules change.

Unit 3: AML, KYC, and sanctions compliance

  • Identity evidence one regime accepts and another rejects.
  • Local uplift applied to a file the group already cleared.
  • Deadlines that two regimes count from different dates.
  • Alert review split between a local team and the group.

Unit 4: Managing cross-border compliance risks

  • Answering a data request barred by a blocking statute.
  • Data localization against a central screening obligation.
  • Outsourcing a control to a provider in another country.
  • Two regulators' files that cannot carry different answers.

Unit 5: Building compliance resilience in global markets

  • Writing central policy that each market can execute.
  • Names that screen differently in three scripts.

The course uses enforcement notices, supervisory findings, obligation registers and monitoring outputs from multi-jurisdiction organizations.
