Course overview
Tax law is where accounting, law and public opinion collide. A position can be technically correct, legally defensible, and still cause serious damage when it appears in a newspaper next to the company's effective tax rate. The compliance burden has grown at the same time: real-time reporting, country-by-country disclosure and automatic information exchange have made the tax function's data problem as large as its technical one.
This course covers tax law and compliance across five units: the foundations, corporate taxation and risk management, international tax and cross-border issues, financial compliance and governance, and future trends. It is educational and is not tax or legal advice.
The three questions behind any tax position
Is it correct in law. Can it be evidenced with documentation a tax authority will accept. And would it survive publication. A position that fails any of the three is a liability, and many organizations only test the first.
The second question is where most disputes are actually lost. Transfer pricing, in particular, is rarely about whether the arrangement is defensible in principle; it is about whether the documentation, prepared contemporaneously, supports the price that was charged.
